Judicial Conduct Tribunal Hears Testimony in Sexual Harassment Case Against Eastern Cape Judge President Selby Mbenenge

Johannesburg â€“ The Judicial Conduct Tribunal continues to hear testimony in the sexual harassment case against Eastern Cape Judge President Selby Mbenenge, with complainant Andiswa Mengo expected to conclude her evidence.

Mengo, a High Court secretary, has accused Mbenenge of sending her inappropriate text messages, explicit images, and making unwanted sexual advances between 2021 and 2022. She has been on the witness stand since Monday, detailing the nature of the messages, pictures, and videos she allegedly received from the judge.

Allegations of Explicit Messages and Requests for Private Images

During her testimony, Mengo recounted an incident in July 2021 when she confronted Mbenenge about why he had deleted a series of messages. The judge allegedly responded that it was to prevent a scenario where a child might see them, stating in a message:

“Your child will be worried to learn that at some point you will encounter large nto.”

When asked what she understood by this message, Mengo, assisted by an interpreter, testified that she believed the judge was referring to his genitalia.

She further alleged that on the same evening, after she attempted to end the conversation and go to sleep, Mbenenge requested that she send him explicit images. Evidence leader Advocate Salome Scheepers read one of the alleged messages from the judge:

“Please send a juicy pic before you sleep.”

Mengo testified that she interpreted this as a request for an intimate image of her private parts.

Claims of a Collage Depicting Sexual Positions

In a further revelation, Mengo told the tribunal that on July 18, 2021, Mbenenge allegedly sent her a collage of various sexual positions. He reportedly instructed her to view the image privately before later deleting it.

Mengo testified that she initially responded to the image with the word “nice.” Following this, the judge allegedly made further sexual suggestions, stating that it seemed she preferred “half insertion.” Mengo responded with, “foreplay kindles,” which she explained was in line with the type of response she believed Mbenenge was expecting.

When asked by Advocate Scheepers about her engagement in the conversation, Mengo clarified:

“I responded in this manner because he wanted this to come from me—to indicate what style I liked and what should happen first.”

The tribunal continues to examine the evidence, including WhatsApp messages, as part of its investigation into the allegations.

The proceedings are ongoing.
